The People´s Deputies declared that
the bill (Reg. No.4604), submitted by People´s Deputy of Ukraine D. Prytynka, amends the Code of Economic Procedure of Ukraine to
regulate the procedural legal succession in the economic process to strengthen
protection of rights and legitimate interests of the parties.
The People´s Deputies suggested amending clauses 25, 62, 79, 80 of the Code of Economic Procedure of Ukraine to extend the grounds and subjects of the procedural legal succession, as effective economic process does not settle the issue of procedural legal succession in case of death of an individual who may be a party in the court proceedings. Thus, only clause 79 of the Code of Economic Procedure of Ukraine contains similar principles concerning entrepreneurship and organizations.
All the actions in the course of the court proceeding before coming into legal succession are compulsory for the legal successors to such an extent as for the person succeeded.
The economic court renders judgment on change or refusal of a party change by its legal successor.
